American arrested for spying for Israel
The American Jewish man arrested this week for spying for Israel was released on $300,000 bond.
The Justice Department disclosed Tuesday that Ben-Ami Kadish, a mechanical engineer at a U.S. Army facility in Dover, N.J., was arrested on charges of relaying secrets to Israel from 1979 to 1985, including nuclear secrets. Kadish speaks Hebrew and has an Israeli brother, according to the Justice Department.
Kadish allegedly "borrowed" classified documents from the facility's library and took them home to be copied by an Israeli diplomat employed at Israel’s consulate in New York, according to a sealed complaint filed Monday in a federal district court in New York.
One of the documents "contained information concerning nuclear weaponry and was classified as 'Restricted Data,' a specific designation by the U.S. Department of Energy, because the document contained atomic-related information," said a statement Tuesday from the Justice Department.
Another classified document "contained information concerning a major weapons system -- a modified version of an F-15 fighter jet that the United States had sold to another country. This document was classified by the Department of Defense as 'Secret' and was further restricted as 'Noforn,' or 'Not Releasable to Foreign Nationals.'"
Kadish, who allegedly was not paid for relaying the documents, appeared in court Tuesday and was released after posting $300,000 bond, putting his New Jersey home up as collateral.
He allegedly spoke with his Israeli co-conspirator by phone on March 20, before he was due to meet with U.S. officials. According to the Justice Department, the Israeli instructed Kadish to lie to law enforcement officials. The following day, March 21, Kadish denied having had the phone call.
The alleged spying took place before U.S. Navy analyst Jonathan Pollard was sentenced to life for spying for Israel. Israeli diplomats have said that Pollard's case led the United States to increase its information sharing with Israel and at the same time led Israel to clamp down on any Israeli espionage in the United States.
Ben-Ami, who lives in New Jersey, grew up in pre-state Palestine and fought with the Haganah, the Jewish military organization that was the precursor to the Israel Defense Forces, according to a 2006 story on Kadish and his wife, Doris, published in the New Jersey Jewish News. Ben-Ami served in both the British and U.S. militaries during World War II and is an ex-commander of the Jewish War Veterans Post 609 in Monroe, N.J., the story said. Man Arrested for Disclosing National Defense Information to Israel
MANHATTAN — Michael J. Garcia, the U.S. Attorney for the Southern District of New York, Mark J. Mershon, the Assistant Director-in-Charge of the New York Office of the Federal Bureau of Investigation (“FBI”), and Weysan Dun, the Special Agent-in-Charge of the Newark Office of the FBI, in conjunction with the U.S. Army, announced today the arrest of Ben-Ami Kadish on charges that he participated in a conspiracy to disclose to the Government of Israel documents related to the national defense of the United States and, in connection with that unauthorized disclosure, that he participated in a conspiracy to act as an agent of the Government of Israel. According to the Complaint filed in Manhattan federal court:
From about 1979 through 1985, Kadish, a citizen of the United States, was a mechanical engineer, employed at the U.S. Army’s Armament Research, Development, and Engineering Center at the Picatinny Arsenal in Dover, New Jersey (the “Arsenal”). The Arsenal kept a library of documents with classified information related to the national defense of the United States (the “Library”).
On numerous occasions during this time period, Kadish borrowed classified documents (the “Classified Documents”) from the Library and took the Classified Documents to his residence in New Jersey (the “Residence”). At the Residence, Kadish would then provide the Classified Documents to a co-conspirator not named herein as a defendant (“CC-1”), who would photograph the Classified Documents in the basement of the Residence.
From at least 1980 through 1985, CC-1, a citizen of Israel, was employed by the Government of Israel as the Consul for Science Affairs at the Israeli Consulate General in Manhattan and directed Kadish to provide the Classified Documents to him (CC-1).
One of the Classified Documents that Kadish provided to CC-1 contained information concerning nuclear weaponry and was classified as “Restricted Data,” a specific designation by the U.S. Department of Energy, because the document contained atomic-related information.
Another one of the Classified Documents that Kadish provided CC-1 contained information concerning a major weapons system -- a modified version of an F-15 fighter jet that the United States had sold to another country. This document was classified by the Department of Defense as “Secret” and was further restricted as “Noforn,” or “Not Releasable to Foreign Nationals.”
Another one of the Classified Documents borrowed by Kadish from the Arsenal Library contained information concerning a major weapons system and major element of defense strategy -- the U.S. Patriot missile air defense system. This document was classified by the Department of Defense as “Secret.”
On March 20, 2008, Kadish and CC-1 had a telephone conversation, during which CC-1 instructed Kadish to lie to federal law enforcement officials. The following day, during an interview with the FBI, Kadish denied having had the telephone conversation with CC-1.
Kadish is charged with four counts: one count of conspiring to disclose documents related to the national defense of the United States to the Government of Israel; one count of conspiring to act as an agent of the Government of Israel; one count of conspiring to hinder a communication to a law enforcement officer; and one count of conspiring to make a materially false statement to a law enforcement officer.
Kadish is scheduled to appear this afternoon before United States Magistrate Judge Douglas F. Eaton in Manhattan federal court.
Mr. Garcia praised the FBI and the U.S. Army for their efforts in this continuing investigation.
This prosecution is being handled by Assistant United States Attorney Iris Lan of the U.S. Attorney’s Office for the Southern District of New York and Trial Attorney Kathleen Kedian of the Counterespionage Section of the Justice Department’s National Security Division.
The charges and allegations contained in the Complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty.

US Army engineer arrested on suspicion of spying for Israel

An 85-year-old former US Army mechanical engineer was arrested Tuesday on charges he slipped classified documents about nuclear weapons to an employee of the Israeli Consulate who also received information from convicted Pentagon spy Jonathan Pollard, US authorities announced.
Ben-Ami Kadish was charged in US District Court in Manhattan with four counts of conspiracy, including allegations that he disclosed US national defense documents to Israel and acted as an agent of the Israeli government.
At a court hearing Tuesday afternoon, Kadish, who was wearing black sweatpants, was released on a $300,000 property bond. He was required tosurrender his passport and can travel only in New Jersey and southern Manhattan. A potential preliminary hearing is set for May 22.
Prosecutors say Kadish, a US citizen who worked at an Army base in New Jersey, took home classified documents for six years and let the Israeli photograph them in his basement. Those documents included information about nuclear weapons, a modified version of an F-15 fighter jet, and the US Patriot missile air defense system.
A criminal complaint said Kadish confessed to FBI agents on Sunday that he had given the Israeli between 50 and 100 classified documents and accepted no cash in return, only small gifts and occasional dinners for him and his family.
Kadish admitted to the charges in court, saying that he wanted to help Israel.
Calls requesting comment from the Israeli consulate in the United States were referred to officials in Israel.
The Prime Minister's Office referred queries on the matter to the Foreign Ministry. Foreign Ministry spokesman Arye Mekel said: "We know nothing about it. We have nothing to say."
Kadish worked at the Armament Research, Development and Engineering Center at the Picatinny Arsenal in Dover, New Jersey. On numerous occasions between 1979 and 1985, the agent provided Kadish with lists of US national defense classified documents he was interested in, according to the complaint. Kadish worked at the military facility from 1963 through 1990.
The complaint described a close relationship between the two men that continued beyond 1985, and included telephone and e-mail conversations exchanged as recently as Sunday.
The unidentified Israeli agent - since identified in Israel as Yossi Yagur - was described in the complaint as a one-time employee of Israeli Aircraft Industries, which since at least the late 1970s has been a defense manufacturing contractor for the Israeli government. The company is now known as Israeli Aerospace Industries.
From July 1980 through November 1985, Yagur worked for the Israeli government as the consul for science affairs at the Israeli consulate in Manhattan.
The two men were introduced by Kadish's brother, who worked with Yagur at the manufacturing plant in Israel.
The research center where Kadish worked housed a library of documents, including many with classified information related to US national defense. From 1979 through 1985, Kadish signed out at least 35 classified documents, according to the complaint.
Kadish told the FBI that he knew that one restricted document he provided to Yagur included atomic-related information and that he did not have the required clearance to borrow it, according to the complaint.
Prosecutors say Yagur called Kadish on March 20 and told him to lie to federal law enforcement agents who were investigating possible espionage.
"Don't say anything. Let them say whatever they want. You didn't ... do anything. ... What happened 25 years ago? You didn't remember anything," Yagur allegedly told Kadish in Hebrew.
In addition to the spying counts, Kadish is charged with conspiring to hinder a communication with, and to make a materially false statement to, a law enforcement officer. Those charges stem from the March conversation.
Yagur left the United States in November 1985 and has not returned, according to the complaint, which described him as the same Israeli to whom Pollard provided classified information.
Pollard, a former civilian intelligence analyst for the US Navy, pleaded guilty to transferring military secrets to Israel while working at the Pentagon. He is serving a life sentence in a US federal prison.
US State Department spokesman Tom Casey said that more than 20 years ago, when the Pollard affair emerged, the US said that it had not expected such conduct from a close ally and that the same applied in the Kadish case.
Pollard's wife, Esther, a vocal critic of both the US and Israeli governments' handling of her husband's case, said there was no connection between Kadish and her husband, and expressed concerned that the new case "could result in a further delay in Jonathan's release from prison."
"This kind of propaganda plays right into the hands of the people in Israel who are not interested in Jonathan's release," she said.
The Kadish story, she added, was no different from other reports that have been used in the past to embarrass Israel, and called upon Prime Minister Ehud Olmert "not to be distracted by this case from what he should be doing and that's bringing Jonathan home."
She said she was worried that Olmert might now decide that it was "too delicate a time" to make a serious effort to bring Jonathan home in honor of Israel's 60th birthday celebrations.
Gerrie Bamira, the executive director of the Jewish Federation of Greater Middlesex County, in which Kadish's home in Monroe Township is located, said she knew Kadish and his wife, Doris, through their supported of the Federation.
"Information is still being gathered with respect to this case, and we look forward to the due process of law," Bamira said. "Individuals are innocent until proven guilty."
According to some accounts, Kadish was born in Connecticut and moved to pre-state Israel, where he fought with the Hagana. Other accounts say he served in the American military during World War II.

FORMER CHINESE NATIONAL CONVICTED FOR

First Conviction in the Country Involving Source Code Under the Arms Export Control Act
WASHINGTON– Xiaodong Sheldon Meng, 42, formerly a resident of Beijing, China, and resident of Cupertino, Calif., pleaded guilty yesterday to violating the Foreign Economic Espionage and violating the Arms Export Control Act (AECA) and the International Traffic in Arms Regulations (ITAR), announced Assistant Attorney General for National Security Kenneth L. Wainstein and Scott N. Schools U.S. Attorney for the Northern District of California.
The defendant entered into a plea agreement whereby he pleaded guilty to Count Five (EEA) and Count Seven (AECA) of a superseding indictment that had been filed on December 13, 2006.
Count Five charged that Meng violated the EEA by possessing a trade secret belonging to Quantum3D, a San Jose company by whom he was formerly employed, intending and knowing that this possession would benefit a foreign government, instrumentality, or agent, namely the People’s Republic of China ("PRC") Navy Research Center.
The trade secret at issue, known as "Mantis," is a Quantum3D product used to simulate real world motion for military training purposes. Meng installed a demonstration unit of Mantis on the PRC Navy site. Meng also altered Mantis to make it appear as if it belonged to ORAD, Meng’s new employer, a competitor of Quantum3D based in PRC. This altered version of Mantis was included as part of the demonstration project in the PRC.
Count Seven charged that defendant Meng knowingly and willfully violated the AECA and ITAR when he exported "viXsen" source code, a Quantum 3D product that is a designated defense article on the United States Munitions List, and for which Meng had no Department of State export license. viXsen is a visual simulation software program used for training military fighter pilots.
United States Attorney Scott N. Schools noted that this prosecution is the result of a nearly three-year joint investigation by the U.S. Attorney’s Office Computer Hacking and Intellectual Property (CHIP) Unit, the Federal Bureau of Investigation (FBI), the Department of Homeland Security, Immigration and Customs Enforcement (ICE) - Office of Investigations, as well as Customs & Border Protection (CBP). The Department of State and the Department of Defense also provided valuable assistance on the case.
"This conviction, the first in the nation for illegal exports of military-related source code, demonstrates the importance of safeguarding our nation’s military secrets and should serve notice to others who would compromise our national security for profit," said Assistant Attorney General for National Security Kenneth L. Wainstein. "This case is the latest evidence of the Department’s enhanced investigative and prosecutorial efforts to keep America’s critical technology from falling into the wrong hands."
"One of ICE’s top priorities is ensuring that U.S. military products and sensitive technology does not fall into the hands of those who might inflict harm upon America or its allies," said Julie L. Myers, Department of Homeland Security Assistant Secretary for ICE. "These items, such as the proprietary source code stolen and altered by the defendant in this case, are controlled in the interest of national security. We will continue to work with our law enforcement partners and industry to enforce U.S. technology export laws."
"The economic -- and often national -- security of the United States rests largely upon a foundation of technological superiority, and to maintain that superiority our trade secrets must be protected with the fervency with which we guard other vital interests," said Charlene B. Thornton, special agent in charge of the FBI’s San Francisco office. "The successful prosecution of Mr. Meng is a blow to those who seek to circumvent the long and costly process of research and development to gain a technological advantage through lies, deceit, and theft; it is a victory in the struggle to ensure the economic security of Silicon Valley and the United States."
Quantum3D, Inc. has cooperated fully in the government's investigation. A company official noted that the company "believes that enforcement of export and trade secret laws is critical to the functioning of our industry and we’re pleased to work with the government in these efforts."
The U.S. Attorney’s Offices in the Northern District of Alabama, District of Minnesota, and Middle District of Florida also joined the plea agreement as some of the conduct in the case occurred in those jurisdictions.
Defendant Meng is scheduled to be sentenced before United States District Judge Jeremy Fogel in San Jose on January 23, 2008, at 10:00 a.m. Meng is currently out of custody on $500,000 bond.
Under the terms of the plea agreement, the maximum term of imprisonment is twenty-four months. Meng also is subject to a maximum fine of $500,000 on the Economic Espionage Act conviction and a maximum fine of $1,000,000 on the Arm Export Control Act conviction, and a three-year term of supervised release. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.

Prior Economic Espionage Prosecutions:
According to the U.S. Department of Justice, the Meng case is the second conviction and only the third case charging violation of the Economic Espionage Act (EEA) of 1996, under 18 U.S.C. § 1831. Both EEA convictions have been obtained within the last nine months by the CHIP Unit in the Northern District of California.

FBI Analyst Sentenced To 10 Years
For Stealing National Secrets

A former U.S. Marine and FBI analyst was sentenced to 10 years in federal prison for espionage charges in connection with stealing classified national defense documents from the White House, the FBI, the Department of Defense, and the U.S. Department of State.
Leandro Aragoncillo, 48, received his sentence on Wednesday in U.S. District Court in Newark, N.J. A release from the Department of Justice noted that there is no parole in the federal system, and Aragoncillo, who also was fined $40,000, can be expected to serve nearly the entire sentence except for potential "good-inmate" credits.
Aragoncillo used text messages, Web-based e-mail accounts and database queries to pull off the espionage. But it was the same technology that helped the government track him down and build a case against him. The e-mails sent, the phone calls made, and the stolen information archived on a set of CDs all left a digital trail that was his ultimate undoing.
"Those charged with protecting the nation have a special responsibility to maintain their oath of loyalty to the United States," said Kenneth L. Wainstein, Assistant Attorney General for National Security, in a statement. "As a former U.S. Marine and FBI analyst, Aragoncillo betrayed that oath, violated our espionage laws, and now must suffer the consequences of his actions."
Aragoncillo's case marks the first time in modern history that someone has been charged with spying out of the White House .
The man who was a career Marine and had served under two vice presidents in the White House had pled guilty to stealing information in an attempt to foster a political coup in the Philippines, his home country. At his plea hearing last year, Aragoncillo admitted that he regularly transferred to his Philippine contacts national security documents classified as Secret. He also admitted traveling to the Philippines in January 2001 to meet his co-conspirators, including a visit to the Malacanang Palace, the official residence of the president of the Philippines.
In 2005, federal agents executed search warrants on the houses of Aragoncillo and his U.S.-based conspirator, Michael Ray Aquino, a resident of the Philippines who was in the country on a visa. Both men were arrested after agents found more than 736 classified documents between the two homes.
The arrests marked the end of what prosecutors called a "criminal conspiracy against the United States that spanned the globe, involved the theft of classified national defense documents" from the White House, the FBI, the Department of Defense and the U.S. State Department. The scheme included a group of conspirators who ranged from the former Marine turned FBI analyst to an ousted Philippine president to a foreign intelligence officer on the lam from double murder charges.
"The sentencing of Leandro Arangoncillo brings to a close a harmful and disgraceful story of how a formerly trustworthy FBI employee and U.S. Marine can turn into an enemy of the American people and the American way of life," said FBI Special Agent in Charge Weysan Dun, in a written statement. "Aragoncillo and his cohort, Michael Ray Aquino, have come full circle in the justice system, and for them the circle ends at a federal penitentiary."

Never in our recorded history have so many Intelligence Agencies, the Military and the Politicians conspired to keep one man in jail. Their zeal verges on mass hysteria which is so blatant it makes one wonder if they are anxious to protect the United States - or themselves.
Jonathan Pollard betrayed a trust - or did he? He gave Israel information about Soviet supplied weapons to Iraq, Syria, Libya and other Arab countries, including NBC (Nuclear, Biological and Chemical) materials and missile technology to deliver it. According to several prior MOUs (Memorandums of Understanding) including 1983 by a long line of American Presidents and Congress, this vital information was to be shared with Israel as part of American policy to insure Israel's defensive viability against a host of surrounding hostile Arab countries.
And yet powerful men like Defense Secretary Caspar Weinberger and Admiral Bobby Ray Inman, Deputy CIA Director embargoed this life and death information from Israel. Inman was enraged by Israel's bombing of the Iraqi nuclear reactor at Osirak in 1991 and from that point on, deliberately withheld this information from Israel. Weinberger tried to insure a "Level Playing Field" for the combined Arab confrontation States arrayed against Israel. (What exactly was the Weinberger - Inman relationship with Saddam which enraged them.)
Caspar Weinberger revealed his knowledge of Saddam Hussein's intentions to use gas capability against Israel during a radio interview which we heard during the first SCUD attack on Israel, January 18,1991. Weinberger said: "It's a shame that Saddam is using poison gas against Israel." In 1983 when Pollard protested the embargo of this information from Israel, he was told by his superiors: "Don't tell the Jews. They're too sensitive about gas." Weinberger's secret memorandum to Judge Aubrey Robinson before his sentencing of Pollard to "Life with No Parole" has never been shown to any of Pollard's lawyers, violating American justice of the defendant's rights to confront his accusers. We know from Justice Arthur Goldberg's admission that Weinberger falsely accused Pollard of spying for South Africa to enrage Judge Robinson (who is black).
After the US government abrogated its plea agreement with Pollard, they locked him down in solitary first in a prison for criminally insane and then at Marion Illinois' maximum security prison for over 7 years. He is now in his 14th year of prison (Now 21 Years) - 4 times what others who spied for allies received. Clearly, the conditions of lock-down were more than to keep him isolated and more like an effort to break him, possibly ending in a staged suicide.
Whenever the American and Israeli people, the Congress and the Knesset have moved in unity to urge commutation of Pollard's sentence to time served or for any kind of leniency against his sentence of "Life with No Parole", the Intelligence community has arisen in a vast coordinated movement to stop it. By now the punishment has gone beyond any imprisonment of any spy, particularly one who warned an ally that Saddam Hussein was building up his NBC (Nuclear, Biological and Chemical) arsenals - with Israel as his first target. Several spies for enemies like the Soviet Union have been released after 4, 6, 9 and 19 years (of a 40 year sentence) respectively. The maximum sentence for spying for an ally is 10 years, the median sentence is 2-4 years or nothing.
Was the release of Jonathan Pollard after 14 years a risk to the nation years after the secrets were stale? Or were these same Intelligence Agencies, Presidents, Vice Presidents, Defense Secretaries acting so maliciously because of their own risk of exposure as co-conspirators in a nefarious plan to eliminate an ally, Israel, whose presence disturbed their Arab oil market clients? Angelo Codevilla, professor of International Studies at Boston University and former Naval Intelligence officer served on the staff of the US Senate Select Committee on Intelligence during the Pollard arrest and conviction. He has written that: "Some US intelligence experts say the Intelligence community in Washington no longer opposes Pollard's release. The group that wants to keep Pollard in jail consists mostly of those who dealt with the case in the mid 1980s: Weinberger, Bobby Ray Inman and the US prosecutors [possibly one desperate former President]. It is a straightforward political matter.
"In briefings to the Senate Committee, US officials never claimed that Pollard gave intelligence methods and sources to Israel. Instead, he relayed data, analysis and photographs - the sort of material that Israel had received from the US. Pollard angered US government leaders by his effort to undermine what he regarded as a pro-Iraqi policy by Washington. The US policy of aiding Iraq was a disastrous policy which led to the Gulf War. The authors of that policy were Shultz, Weinberger and Inman." "Inman said they [the Israelis] had used US satellite pictures to plan the bombing [of Osirak]..and had harmed sophisticated US efforts to build an important relationship with Saddam. Therefore, he [Inman] personally cut Israel off from satellite information about Iraq and later began to send satellite pictures to Saddam." (1)
George Bush, then VP (former Director of the CIA) and Jim Baker (Reagan's Treasury Secretary) were deeply involved in manipulating the Reagan administration's buildup of Iraq, a policy they continued as President and Secretary of State until the day Saddam invaded Kuwait. And, since Bush ended his Desert Storm after only 4 days on the ground, allowing Saddam and his top Revolutionary Army to survive, facilitating his transfer of 100 jets to Iran (later shipped to Syria), one wonders about their complicity in building Saddam's Weapons of Mass Destruction and responsibility for its eventual victims. This includes victims of the Gulf War - as well as those casualties of Saddam's poison gas attacks against Iran and his own Kurdish citizens.
Another question begging for an answer: Was Saddam given President Bush and Sec. of State Baker's approval to invade Kuwait, to take its $80 billion in assets so Saddam could continue his massive purchases of weapons and continue fulfilling our aberrant foreign policy? According to reports, US Amb. April Glaspie under orders from Baker, told Saddam "the US wasn't interested in his border disputes." This was the "green light" for Saddam to invade Kuwait.
Saddam still claims Kuwait Iraq's sovereign territory. So it's not over yet. Thanks to Bush/Baker's premature halt to the first Gulf War and to Clinton's wimpy occasional bombing, Saddam is still the power and threat to the Middle East. Denials notwithstanding, Col. Scott Ritter disclosed that Secretary of State Albright had interfered with UNSCOM's surprise inspections to avoid a political confrontation with Saddam in order to continue our foreign policy to protect him. (2) Is it OK for the CIA to spy in Iraq today in order to expose Saddam's NBC arsenal, but in 1984 it wasn't OK for Pollard to blow the whistle on Saddam's intention to eliminate Israel? Saddam declared that he would "burn half of Israel" - and he had the weapons from the West to do it.
For years Pollard's accusers hinted mysteriously that he had done terrible things such as betraying the intelligence methods and identities of American spies in the Soviet Union. But, lo and behold, the spy who did this turned out to be a deep and powerful CIA mole who himself created the disinformation against Pollard because he was in charge of that brief. Aldridge (Rick) Ames, chief of the CIA's Soviet/Eastern Europe counterintelligence, was convicted of the very crimes for which he accused Pollard and which precipitated the deaths by execution of at least 34 of these American and allied agents in the Soviet Union. Ames identified 55 clandestine US and allied operations in the Soviet Union, thus causing the deaths of many others.
However, even after Ames was revealed as the spy and mole who caused these deaths by his leaks to the USSR, Pollard was then and is still being falsely accused by the Intelligence Agencies of Ames' crimes. Pollard has been wrongfully blamed for the deeds of a CIA Director (Ames) who had for years transferred every secret he could lay his hands on. One can understand why the present CIA Director, George Tenet tasked to improve the image of the CIA, would threaten to resign if Pollard were released. The coverup of the CIA failure was to be erased from the American mind by keeping Pollard as their permanently jailed scapegoat.
According to former Justice Department attorney John Loftus, "In order to hide his own espionage for the Russians, Rick Ames successfully point the finger of suspicion at Pollard for the spate of serious leaks that crippled US networks inside the Soviet Union." How does Loftus know? He cites: "recent disclosures in the ‘intelligence community'. Several investigations from the CIA and NIS (Naval Investigative Service) have made sheepish admission that Pollard was the victim of hysterical over-reaction." The first key to this turnaround, says Loftus, is "the recent confession of CIA agent Ames that he (not Pollard) was responsible for leaking top level secrets to the Kremlin." Loftus quotes Naval Intelligence sources as admitting that "90 percent of the things we accused [Pollard] of stealing, he didn't even have access to." (3)
John Loftus wrote in "Secret War Against the Jews: How Western Espionage Betrayed the Jewish People 1920-92" that "Pollard had little access either to communications intercepts or satellite data , let alone secret NSA codes. His primary access US Navy data banks on ocean shipping. His private focus was on arms shipments to terrorists." Which, according to Loftus, "is where the ugly truth lies. Pollard noticed a pattern of vessels back and forth from Greece to Yemen, where the PLO had a major base. Summer of 1984 the Israelis tipped off the Greek authorities to seize an entire shipload of arms destined for the PLO. Neither Pollard nor Israel was aware that they had smashed George Bush's first shipment of arms to Iran. The British Secret Service had arranged the Greek shipment to ransom American hostages held in Lebanon. Pollard never realized that he had busted the most secret White House operation of modern times. The summer 1984 Greek shipment was a dagger over George Bush's head. The Greek shipment in 1984 exposes the entire White House coverup." (4)
Jerry Agee, Pollard's superior in Naval Intelligence told Wolf Blitzer, he and another colleague were suspicious of the number of classified documents Pollard was taking home with him. They concluded that the information was almost certainly going to Israel. As the materials dealt with Soviet weapons systems and Arab military capabilities, it was not something the Soviets would be interested in. As Agee said to Blitzer: "It didn't take a fool to find out that the Soviets were not buying back all their own information." (5)
Now, with President Clinton about to commute Pollard's sentence, the Intelligence, Military and Justice Department communities have become frantic. As a desperate measure they released, through a journalist who was fed the "correct" information, the great secrets that Pollard was to have transferred.
On January 11, the deadline day of Clinton's promised clemency decision, an article was printed in the NEW YORKER by Seymour Hersh. Of course, the article was cooked and planted by the same Intelligence Agencies, and "leaked" it to a journalist known for his susceptibility for sensational stories. Of course, Seymour Hersh is known for gullibly accepting the disinformation, including rumors, he propagates in the Pollard chapter of his book "The Samson Option." Hersh gains much profit by the credibility the NEW YORKER article lends to his reputation and his book. But, Hersh is thought to be an ‘empty vessel' into which the disinformation entities pour their vitriol.
What is so outrageous about the NEW YORKER article is that Hersh drowns his listener in what even he calls "Tom Clancy" stuff - details and extrapolations of technical espionage that the US carries on against friends and allies alike. He fails to footnote, uses numerous "unnamed" sources: and quotes all the defamatory false accusations we've seen piled up against Pollard since 1985. One man he does quote by name is a former convict, now journalist. However, in alia, Hersh reveals that the US does indeed spy on its friends and allies, including especially Israel. Nothing is mentioned regarding US transfer of this information to such nations as Saudi Arabia, Syria or Iraq - consistent with an aberrant foreign policy pushed by special oil interests.
And, of course, in this day of the Internet and instant communications, it simultaneously appears in the NEW YORK TIMES: "US Now Tells of Must Deeper Damage by Pollard Than Thought" by Tim Weiner and repeated in the JERUSALEM POST: "Pollard Stole 10-volume Intelligence ‘Bible'", etc. They threw in every false accusation printed before and made up now for "effect" - to scare off those members of Congress, Knesset,
American and Israeli publics who smell a collective rat. Most have appeared before and been refuted:
Volume of material: an absurdity. He would have needed a moving van on several occasions. Inveterate liar: (9 months of polygraphs proved Pollard told the truth.) Cocaine abuser: Accuser a convicted felon. Disproved along with spurious and salacious charges of alcoholism and homosexuality. A test for drug use by a private physician was negative. Strangely, that medical file disappeared.
These now-to-be released "secrets" of what Pollard was to have stolen include a "10 Volume Directory of electronic frequencies and signals intercepted by the NSA (National Security Agency - the US primary electronic eavesdropping service and its biggest espionage entity) which listens to every nation in the world. Hersh admits there is no documented proof for the accusations leaked to him.
But, if this was that important, why hadn't the Soviets tasked Aldridge Ames to secure these volumes. Clearly, Ames had the highest level of security rating and access to this information years earlier. It would seem that our Intelligence Agencies, in an effort to keep hidden some of their ugly work against Israel, huddled and thought up a number of chilling scenarios which they could feed to the President (distracted by his own personal trials) and the American citizens via the media to justify their unjust continued imprisonment of Pollard. But, mostly they acted to assure their own personal safety and continued employment.
Have our President, Military Intelligence, CIA, NIA, NSA or politicians every lied to us? You bet. Do Politicians lie? Examine the Iran/Contra and Iraq-gate lies. Yes, indeed, these people are following the psychology explained by Carl Jung, wherein you blame your victim for what you are about to do to him.
"They" are telling us Pollard committed "Treason" (which he was never accused of nor indicted for). But, it was "They" who aided Saddam to build up his NBC arsenal, that, according to VP Al Gore, could kill off all the people on Earth. The "They" who should be questioned includes, among others: George Bush, Caspar Weinberger, Bobby Ray Inman, prosecutor Joseph Di Genova, George Shultz, James Baker, Brent Scowcroft, and various heads of the Intelligence Agencies and Justice Departments during the 1980s and 1990s. They have been aided and abetted by willing journalists, always eager for the scoop and sensation that gets them and their papers or TV/radio stations profits and good ratings.
The great American nation and its wonderful people have been an example to the world in its humanity for others. True, we have our crooks, our dirty politicians, our murderers and rapists - like all other nations. The problem is that as a super-power, we attract the power brokers who believe they know best. We find them often at the highest levels of government and in our Intelligence Agencies. They all believe they are doing right for the country and themselves by using any means - illegal or unethical - to a achieve their goals. They know the American people would not approve of their methods and so they go underground.
"They" tell us Pollard is guilty of crimes not originally spoken about during his "in camera" hearing. Pollard never had a trial. He gave up his right to a trial because they promised his ill wife Anne better treatment with no prison term and a light sentence for Pollard. The government broke its plea agreement and Pollard received a life sentence. Let us then have an open, fair trial where his accusers can openly charge Pollard and then have their accusations tested by lawyers who know to dig out the facts from this reluctant cabal bent on keeping themselves out of the docket and possibly jail. Let the liars lie under oath and we'll see where it leads.
Some may recall the hearing at an Appeals Court where three judges heard some of the evidence. Two concluded on a technicality that it was too late for such a trial. One was Ruth Bader Ginsberg who shortly thereafter was appointed to the Supreme Court. But the third Judge Stephen Williams said that "This was a gross miscarriage of justice." No, he did not receive an appointment to higher position.
So, we have an amoral President, a twisty State Department, Intelligence Agencies who will do anything to achieve their goals and cover their backsides, certain industrialists connected to Arab oil and their markets - all seemingly coalesced to assure that this one man stays in prison til he dies. You have to wonder why.
The true story of the Wye fiasco was exposed by Kenneth Timmerman. "Apparently, at 4 am on Friday at the Wye Plantation President Clinton agreed to a request - not from Mr. Netanyahu but from PLO Chairman Yassir Arafat - to release Pollard as part of a prisoner exchange to get Israel to drop its demand that Israel extradite the 36 Palestinians wanted on terrorism charges. The key terrorist of the 36 was the commander of the Palestinian Police, Ghazi Jabali. Arafat wanted to exchange Pollard for Jabali. President Clinton agreed. Several hours later, after the CIA jawboned him, he back out. And when Mr. Netanyahu balked at Clinton's reversal, Clinton threatened the US would recognize a unilateral declaration of Palestinian statehood in May - the equivalent of dropping a nuclear weapon on Netanyahu and his supporters." (6) Of course, the head of the CIA, George Tenet had to threaten to resign to achieve this full score effect.
This sounds like the Dreyfus Affair, except that Pollard readily admits his guilt for transferring vital intelligence to Israel and has often expressed deep remorse. However, his accusers seem to have adopted a plan to elevate Arab military power to a level that could wipe out Israel.
Pollard was not charged with nor convicted for treason but it is highly probable that his accusers may have committed treason and are now desperately trying to cover up their black deeds.

Jones Video Adds Fuel to Pollard Fire
(IsraelNN.com) With the publication of a video of US Ambassador to Israel Richard Jones' remarks against Jonathan Pollard, calls increase for a retraction and correction - and for clemency for Pollard.
The Justice for Jonathan Pollard (J4JP) organization has circulated a video link at which Ambassador Richard Jones can be seen and heard making his infamous remarks about Pollard. Speaking last week at a Bar Ilan University conference on US-Israeli relations, Jones said twice that Pollard committed treason against the United States. He added bitingly that "it came out clearly in the trial that Jonathan Pollard took money" and that he "sold out" his country.
While J4JP easily and quickly rebutted these claims, other accusations by Jones were less widely publicized. He implied that the American people were punishing Israel itself when he said, "I know he was doing this [spying] for a friend [Israel - ed.], but that's what makes this even more emotional for Americans - that a friend would cooperate in aiding and abetting someone who is committing treason against his own country."
Jones's final biting comment, coming in the context of the above remark, was the most explosive of all: "The fact that he wasn't executed is the mercy that Jonathan Pollard will receive." The double implication that Pollard deserved to be put to death, even though he was convicted on only one count of passing classified information to a friendly nation, and that he would never be freed, had Pollard supporters up in arms and demanding an apology.
The pressure was apparently strong enough to elicit an apology within a matter of hours. Jones said his remarks were "misinformed and misleading," and "did not reflect my personal views nor those of the Bush Administration."
Apology not Accepted by All
The Conference of Presidents of Major American Jewish Organizations welcomed the apology the next day. Though it reiterated its call for Pollard's quick release, the organization said, “We accept Ambassador Jones’ explanation and retraction and believe that it puts this matter to rest."
Other groups, however, were less willing to bury the issue. Rabbi Pesach Lerner, Executive Vice President of the National Council of Young Israel, wrote, "I believe the case cannot be closed. The apology, as is, is still missing a correction of Jones' comments. His facts were wrong [and] he needs to admit that... We must demand a full retraction, correction and perhaps an official inquiry into the sources of his information, the source of his directive to respond with such lies, etc."

J4JP noted that though Jones apologized for daring to say that the US had shown mercy in not executing Jonathan - who never faced anything near a death penalty - he "did not apologize for falsely accusing him of treason or of having taken money. These false charges are soundly contradicted by Jonathan's indictment and by his sentencing transcript, and most important of all by Israel's formal recognition of him as her agent."
Some in the Israeli press, too, were unhappy with the apology - and with Israel's lukewarm response. Two major Israeli dailies, Yediot Acharonot and Haaretz, ran strikingly similar editorials saying that if Israel were "self-respecting" [Haaretz] or "well administered" [Yediot], it would have summoned Jones to the Foreign Ministry and demanded a clarification of his statements.
"It's difficult to accept or understand the American lust for revenge when it comes to Pollard," wrote Yossi Melman of Haaretz. "There's something irrational about it. Jones's remarks were rude and bereft of diplomatic tact, reflecting this American pathology that aspires to keep Pollard from ever being pardoned. Even though Jones has apologized, he deserves to be denounced. By essentially ignoring his comments, Israel is adding insult to the injury it has already done Pollard."
Chief Rabbi Metzger Takes up the Cause in the US
Israel's Chief Rabbi Yona Metzger, currently on a short visit to the New York Jewish communities of Jamaica Estates and Great Neck, is making the most of the recent developments to ask American Jewry to redouble their efforts to work for Pollard's release. The rabbi said today that after he visited Pollard in prison over two years ago, he wrote a letter to US President Bush asking for clemency - and had it signed by every living past and present Israeli chief rabbi.
"I planned to give it by hand to the President," Rabbi Metzger said, "but we received a message that it would be better not to bring it because the subject was too [sensitive] - and so I gave it to the US Ambassador, and he promised that he would give it to the President, but as of now, I have not yet received an answer... We have only two ways to act: Jews all over the world must put a lot of pressure on President Bush as his term draws to a close, and we must pray to G-d that He will save Jonathan's life and rescue him."
Pollard's wife Esther, speaking on the Knesset television channel last week, said that Prime Minister Olmert could capitalize on the situation and make up for past government inaction by raising the matter quietly with President Bush and asking for the release of Pollard as an Israeli agent.
ISRAEL - AMERICA'S SECRET EMEMY
Pollard's Unforgivable Sin
In a recent post on the American Ambassador to Israel saying that the US was merciful in not executing Pollard, there was a link to a post by Robert Olive and a rebuttal. The rebuttal quoted from a court filing that described the damage Pollard caused to the US. It is very instructive:
"Mr. Pollard's unauthorized disclosures have threatened the US [sic] relations with numerous Middle East Arab allies, many of whom question the extent to which Mr. Pollard's disclosures of classified information have skewed the balance of power in the Middle East."
This is unbelievable; yet, it is believable.
In other words, the US didn't want anyone to know the true relationship between the US and its Arab allies. It suggests that the public face it puts on these relationships have nothing to do with reality. This is a matter of utmost importance to both the US and the Arabs. It also suggests that the US knew of Arab plans that were detrimental to Israel and the US was not willing to tell Israel about them.
"Moreover, because Mr. Pollard provided the Israelis virtually any classified document requested by Mr. Pollard's co-conspirators, the US has been deprived of the quid pro quo routinely received during authorized and official intelligence exchanges with Israel, and Israel has received information classified at a level far in excess of that ever contemplated by the National Security Council. The obvious result of Mr. Pollard's largess is that US bargaining leverage with the Israeli government in any further intelligence exchanges has been undermined."
The fact that the US, as a result of Pollard's actions, had fewer bargaining chips is of minor importance. Israel shares most of its intelligence without a specific quid pro quo. But this sentence supports the argument that the US has many secrets that it does not share with Israel. Why does the US keep Israel, ostensibly a friend and ally, in the dark? The US has no need for "bargaining leverage," but it does have a need to not share with Israel the many things it does which are not in Israel's favour.
Thus, Pollard unmasked US policy. This, the US cannot forgive Pollard for.
"In short, Mr. Pollard's activities have adversely affected US relations with both its Middle East Arab allies and the government of Israel."
This sums it up. Pollard made Israel stronger because Israel had a clearer understanding of the true US-Arab relationship, and Arab intentions and plans.
The way I see it, the magnitude of Pollard's sentence reflects the magnitude of the American secrets. One must conclude that the US was duplicitous. It worked to shrink Israel while posturing as its friend.
So, in effect, Pollard was spying for an enemy, Israel, rather than for a friend. His life sentence proves it. I wonder if the US is being so hard-nosed about it in order to please the Saudis?
